Whereas, All political power is derived from The People, who come together to create societies which create government to secure the life, liberty and property of The People;
Whereas, The People are not indentured servants or slaves, subordinate as subjects to the federal government. The people delegate their authority to society in the form of government to secure our rights as a body;
Whereas, Amendment X of the United States Constitution states that the powers not delegated to the federal government are retained by the people and the states, meaning that we did not surrender our powers but merely delegated them;
Whereas, Delegated means “a temporary transfer of trust or authority from a higher power (the people who created the states) to a lower power (the federal government;)”
Whereas, The failure of the federal government to exercise the delegated authority, relegates that authority back to the states and back to the people;
Whereas, “Immigration” is the coming in of people through a legal process with intent to become citizens, “Migration” is the coming in and out without intent to stay, and the current situation is neither migration, nor immigration, as they intend to stay and they are coming in illegally;
Whereas, The definition of “invasion” is an incursion by a large group of people or things into a place, or an unwelcome intrusion into another’s domain and does not require those intruding to be armed, hostile, or otherwise;
Whereas, We are a Constitutional Republic and Article IV, Section 4 of the US Constitution specifies that the United States shall guarantee every state in the Union a Republican form of government;
Whereas, Article IV, Section 4, of the United States Constitution specifies that the US Government shall protect each state against invasion (The term “shall” is not optional, but rather mandatory);
Whereas, Article I, Section 10, Clause 3, states in relevant part that no State shall without the consent of Congress keep troops, enter into any agreement or compact with another State or with a foreign power or engage in war, unless actually invaded or in such imminent danger as will not admit delay;
Whereas, Article I Section 10, Clause 3 limits states’ authority with an “unless” clause;
Whereas, What is occurring on the border is an invasion and we are in imminent danger because of the failure of the Federal Government to act upon their delegated duties;
Whereas, According to Article IV Section 1 paragraph (a) of the Florida State Constitution the supreme executive power shall be vested in the governor, who shall be commander-in-chief of all military forces of the state not in active service of the United States;
Whereas, According to Article IV Section 1 paragraph (d) of the Florida State Constitution the governor shall have the power to call out the militia to preserve the public peace, execute the laws of
the States, suppress insurrection, or repel invasions;
Whereas, Article 1 Section 1 of the Florida State Constitution specifies that all political powers are inherent in the people;
Whereas, Article 1 Section 2 of the Florida State Constitution specifies that all natural persons have the right to enjoy and defend life and liberty, to pursue happiness and to be rewarded for industry, and to acquire, possess and protect property;
Whereas, Article 2 Section 1 paragraphs (a) and (b) of the Florida State Constitution delineate the state boundaries;
Whereas, All persons holding public office takes an oath to “support, protect, and defend the Constitution […] of the United States and of the State of Florida;”
Whereas, The border of the United States and the State of Florida are under siege by invaders with the complicity of the current administration, and the federal government, who have ordered all federal and military assets to stand down; and
Whereas, the requirement to act by our Florida state public officials is authorized and required secondary to the failure of the Federal Government in fulfilling its delegated duties set out in Article I Section 10 Clause 3 and Article IV Section 4 of the US Constitution and above reference Florida State Constitutional provisions, and that the exercise of such authority by our State’s public officers does not require permission from the Federal Government nor approval through any judicial process.
Resolved, That on behalf the people of the State of Florida, the Lee County Republican Party, based upon the authority delegated by the people through the United States and Florida State Constitutions, calls on Governor DeSantis as Commander-in-Chief to call out the militia to suppress and repel the invasion that is occurring on our State by way of the United States southern borders, through contiguous neighboring border-states, commercial and/or private air travel, and via bodies of water which delineate our state boundaries;
Resolved, That we further compel our sheriff and state legislators, as required by their constitutional offices, to do all within their power to protect our borders and state sovereignty from invasion; and
Resolved, That we call upon Governor DeSantis to instruct Attorney General Ashley Moody to file suit against the Federal Government to recoup any costs incurred.
